1. Acceptance
By creating an account or using Toupie, you accept these terms of use. If you don't agree, don't use the service. You must be of legal age (a parent or guardian) to open an account; Toupie is not intended for children.
2. Your account
- You are responsible for the accuracy of your account information and the confidentiality of your password.
- You are responsible for the activity that takes place under your account.
- Let us know without delay at hello@toupie.ai if you suspect unauthorized access.
3. Subscription & billing
- First book free: you can create your first book for free, no card required.
- Famille Toupie subscription: CAD $14.99 per month (plus taxes), including up to 4 books per month and the benefits described on the Pricing page.
- Single books: beyond the monthly allowance, additional books may be purchased individually, at the price shown before purchase.
- Renewal: the subscription renews automatically each month until it is cancelled.
- Prices may change; we'll let you know in advance, and any change will apply to the next billing cycle.
4. The content you create
Your books are yours. You keep your rights to the text, names, and descriptions you provide, as well as to the books generated for your personal and family use.
You grant us a limited license, for as long as it takes to provide the service: to generate, illustrate, store, and deliver your books. This license ends when you delete the content, except for temporary backup copies.
You confirm that you have the right to use the photos and information you upload, including those about other people appearing in your books.
5. Acceptable use
You agree not to use Toupie to:
- Upload photos of a person without their consent (or that of their parent/guardian);
- Create illegal, hateful, violent, or sexually explicit content;
- Impersonate someone else or infringe intellectual property rights;
- Attempt to bypass, overload, or compromise the security of the service;
- Resell or commercially exploit the books without our written agreement.
We may suspend or close an account that breaks these rules.
6. Our intellectual property
The Toupie service — its name, logo, design, code, and models — belongs to us or is licensed to us. These terms transfer no rights to you in the Toupie brand or technology, beyond the right to use the service.
7. Cancellation & refund
- Cancellation: in one click, from Account → Plan. Access continues until the end of the period already paid for.
- Your library: the books you've already created stay accessible, even after cancellation.
- Refund: amounts already billed are generally non-refundable, unless the law requires it. If there's a problem, write to us — we always aim to do things right.
8. Service availability
We aim for high availability, but the service is provided “as is.” There may be interruptions for maintenance, updates, or causes beyond our control. We may change or remove features; a major change will be communicated in advance.
9. Warranties & liability
To the extent permitted by law, Toupie is provided without warranty other than those provided by applicable laws, in particular Quebec's Consumer Protection Act, which may grant you rights that these terms cannot set aside.
To the extent permitted by law, our total liability related to the service is limited to the amount you have paid to Toupie over the past twelve months.
10. Governing law
These terms are governed by the laws applicable in Quebec, Canada. Any dispute falls under the courts of the judicial district of Québec, subject to the rights the law grants you as a consumer.
11. Changes
We may change these terms. In the event of a significant change, we'll let you know by email or in the app before it takes effect. By continuing to use the service, you accept the updated terms.
